Brilliant Idea

I have a simple solution to the whole surveillance question. Let's have the Congress pass a law making it illegal. They can even have a big ceremony and everything. And then, once the terrorists figure they're safe again, let's still listen in on their conversations but not leak it to the press this time.

(This follows my solution to drilling at Anwar that satisfies everyone: do it but don't tell anybody.)

I think the same thing about torture. Make it illegal and then if the executive folk feels compelled to do it, they can. If it is valuable as they said, no one important will care if not, well then let'em pay the consequences. Making certain despicable but sometimes necessary things legal invites legal abuse (bad analogy but think of German clerks who became Nazi bastards). Torture, domestic spying and raping the environment while occasionally necessary should however never be allowed to become routine
